2. Description of the Service
WinePick is a mobile application that assists with wine selection at restaurants. The user photographs the wine list, and the Service analyses the detected wines to provide personalised recommendations based on budget, accompanying dish, and expressed preferences.
The recommendations are informational and subjective. They are generated by artificial intelligence algorithms cross-referencing public information (expert ratings, market prices, common food pairings). WinePick does not guarantee the absolute accuracy of ratings, prices, or the actual availability of recommended wines.
3. Eligibility
WinePick is intended for adults (18 years or older, or the legal drinking age in your jurisdiction). By using the Service, you declare that you are of the required age.
WinePick promotes responsible and moderate consumption of alcohol. We remind you that excessive alcohol consumption is harmful to health.
4. Account and identifier
WinePick does not require account creation with email or password. An anonymous identifier is generated locally on your device at first launch, to enable subscription synchronisation and preference management.
You can consult this identifier at any time in the app's Settings screen, and request its deletion via the "Delete Account" function.
5. Subscription and billing
Access to WinePick's full features requires a paid subscription, available exclusively via the Apple App Store. Billing, renewal, and subscription management are entirely administered by Apple according to the terms in effect on the App Store.
- The price and duration of the subscription are displayed in the app before validation
- Renewal is automatic unless cancelled at least 24 hours before the end of the current period
- Management and cancellation are done from your iPhone, in Settings > [Your Name] > Subscriptions > WinePick, or via the Settings screen in WinePick. You can cancel your subscription at any time, with no cost or penalty.
- No refunds are issued by AppCreations Ltd; any request must be submitted directly to Apple
6. Acceptable use
You agree to use WinePick in a personal, fair, and lawful manner. The following are prohibited:
- Reproduction, resale, or redistribution of the Service or its recommendations
- Any attempt to circumvent technical security or paid access mechanisms
- Use of the Service for commercial purposes without prior written authorisation from AppCreations Ltd
- Injection of illegal, misleading, or rights-infringing content
7. Intellectual property
WinePick, its brand, interface, algorithms, and all content it generates are the exclusive property of AppCreations Ltd or its licensors. Any unauthorised use is strictly prohibited.
Photographs you capture through the application remain your property. You grant us a non-exclusive, worldwide, limited licence to process them solely for the purpose of providing the Service.
8. Methodology and Estimates
This section clarifies how WinePick produces its recommendations and how to interpret the information displayed in the app. It complements, without replacing, the other sections of these Terms.
Q: How does WinePick choose its recommendations?
A: Recommendations are generated by an artificial intelligence model that analyzes your photo, identifies each wine on the menu, then cross-references public information to evaluate their estimated quality: expert ratings, industry consensus, market prices, and customary food pairings.
The scores displayed (out of 100) are estimates derived from this consensus, not official verified ratings. WinePick has no commercial agreement with the critics or platforms whose ratings are taken into account. When no clear consensus is available, the model may omit the score or display "estimated score not available".
The choice of recommendations also takes into account your preferences (color, style, food pairing, budget) if you have provided them in the app.
Q: How does WinePick organize its recommendations?
A: For each wine list analyzed, WinePick provides up to three complementary recommendations, organized along different axes:
- An optimal choice based on your context and your budget if you provided it in the application.
- An alternative on a different axis (different style, different profile, different price range).
- A remarkable bottle from the menu, which may exceed your budget if it is exceptional (flagged as such in the comment).
Depending on the richness of the wine list, WinePick may only propose one or two recommendations if it judges that a third would not add value.
These recommendations are suggestions, not official rankings. Each wine remains a subjective choice that depends on your taste, the context of the meal, and the people you are sharing the bottle with. The exact badge nomenclature and visual representation may evolve between application versions.
Q: How do I read the displayed price and the multiplier (×1.3, ×3, etc.)?
A: WinePick displays two price points:
- The menu price: what the restaurant charges for the bottle.
- The retail benchmark: an estimate of what the same bottle would cost at an independent wine shop or supermarket.
The multiplier (×N) is the ratio between the two. As a guide:
- ×1 to ×2: reasonable markup, average for restaurants.
- ×3: high markup but common in upscale restaurants.
- ×4 and above: very high markup. This doesn't mean the bottle is bad, but the price-to-value ratio is unfavorable to the consumer.
Retail benchmark prices are estimates based on market consensus. They don't account for occasional promotions, specific vintages, or local availability. For an exact price, check with your local wine shop.
Q: Why doesn't a wine I know appear in the results?
A: Several possible reasons:
- The wine is on the menu but the model doesn't have sufficiently reliable information to evaluate it (boutique wines, limited productions, new estates). In this case, the model prefers not to recommend it rather than providing an estimated score.
- The wine wasn't correctly detected due to a blurry photo, poor lighting, or complex typography.
- The wine was detected but doesn't appear in the 3 main recommendations shown: we deliberately limit suggestions to avoid cognitive overload.
- The wine was detected but flagged as "Avoid" because its price-to-value ratio on this menu is unfavorable (it then appears in the warnings section).
WinePick doesn't cover every wine in existence. Our goal is to give you a useful recommendation, not an exhaustive catalog.
Q: How do I cancel my WinePick subscription?
A: You can cancel your subscription at any time directly from your iPhone, at no cost or penalty, by going to:
Settings > [Your Name] (at top) > Subscriptions > WinePick > Cancel Subscription
The cancellation takes effect at the end of the current billing period. You retain access to the service until that date. No automatic refund is issued for the already-paid period. For refund requests, you must contact Apple directly via your iCloud purchase history (App Store > your profile > purchase history > "Report a Problem").
WinePick cannot cancel your subscription on your behalf: billing is fully managed by Apple through your iCloud account.
9. Limitation of liability
The Service is provided "as is." AppCreations Ltd does not guarantee the absence of errors or interruptions, nor compatibility with all devices.
Recommendations are provided for guidance only. AppCreations Ltd cannot be held liable for purchase decisions made by the user based on these recommendations, nor for any discrepancies in price, vintage, or availability encountered at the restaurant.
To the fullest extent permitted by applicable law, AppCreations Ltd's total liability hereunder is limited to the amount actually paid by the user for the subscription during the preceding twelve months.
10. Termination
You may stop using WinePick at any time by uninstalling the app and cancelling your subscription via your Apple account. Complete deletion of your local data is performed via the "Delete Account" function in the app's Settings.
AppCreations Ltd reserves the right to suspend or terminate access to the Service in case of violation of these Terms, without notice or compensation.
11. Amendments
AppCreations Ltd may amend these Terms at any time. Material changes will be notified via the application or by email where applicable. Continued use of the Service after amendment constitutes acceptance of the revised version.
12. Governing law and jurisdiction
These Terms are governed by the laws of the United Kingdom. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of England and Wales, without prejudice to the mandatory consumer protection provisions applicable in your country of residence.
